OSHA penalises JBS Foods for failing to protect employees from Covid-19

The US Department of Labour’s Occupational Safety and Health Administration (OSHA) has penalised JBS Foods in Greeley, Colorado, for failing to protect its employees from the coronavirus (Covid-19).

OSHA took the decision following a coronavirus-related inspection on the company, which operates as Swift Beef Company.

JBS Foods is found to have violated the general duty clause for failing to provide a workplace free from recognised hazards that can cause death or serious harm.

The company also failed to provide an authorized employee representative with injury and illness logs in a timely manner following OSHA’s May 2020 inspection.

The agency proposed $15,615 in penalties.

OSHA Denver Area director Amanda Kupper said: “Employers need to take appropriate actions to protect their workers from the coronavirus. OSHA has meatpacking industry guidance and other resources to assist in worker protection.”

Following the citation, JBS Foods has 15 business days to comply.

The company can request an informal conference with OSHA’s area director, or challenge the findings before the independent Occupational Safety and Health Review Commission.

During the coronavirus pandemic, OSHA provides various measures such as social distancing and the use of physical barriers, face shields and face coverings for employees who cannot maintain a physical distance of at least 6ft.

The guidance also requires employers to maintain injury and illness logs.

Besides, the 1970 Occupational Safety and Health Act has held employers responsible for providing safe and healthy workplaces for their staff.

OSHA is responsible for developing and imposing standards, as well as providing training, education and assistance to ensure safe conditions for America’s working men and women.
